Privacy Policy

This Privacy Policy explains how Chisel Industries Inc. ("Chisel," "we," "us," or "our"), a corporation with its principal place of business at 150 California Street, San Francisco, California 94111, handles personal information collected through the Chisel Tide mobile application (the "App"). This Policy applies only to the App. It does not cover the Chisel Tide web application or any data your employer holds outside the platform.
By using the App you confirm you have read this Policy and that you understand the practices described here. If you do not agree, do not use the App.
1. Who This Policy Applies To
The App is provided to you by your employer or the company that has engaged your services (your "Service Company"). It is intended for use only in the United States by individuals 18 years or older.
2. Our Role and Your Service Company's Role
Your Service Company decides how the data captured through the App is used in its business — for example, which technicians have access, how customer information is handled, and how long records are retained while its account is active. Your Service Company is the controller of that data.
Chisel processes the data on the Service Company's behalf and is responsible for storing it securely, keeping it intact, and operating the App. We act as a service provider (under California law) or processor (under similar U.S. state laws) for the technician-related data captured through the App. We do not use that data for our own purposes other than as described in this Policy.
3. Information We Collect
(a) Information you provide.
- Account information your Service Company sets up for you: work email, name, and role within the Service Company.
- Content you create through the App: photos, service notes, equipment and chemistry readings, customer signatures, and similar records of work performed.
- Voice input: when you use voice features, the App captures a short audio recording and sends it to a speech-to-text service to produce a text transcript. We may retain both the audio recording and the resulting transcript on our servers, alongside the rest of the data captured during the same service visit, and they are subject to the retention rules described in Section 9.
- Profile information you enter about yourself, such as a displayed name or language preference.
(b) Information collected automatically.
- Information from device permissions you grant: camera (for photos), microphone (for voice features), and location services (for arrival and departure timestamps at assigned job sites). Location is captured only while the App is open and active in the foreground; we do not collect location while the App is in the background.
- Technical information needed to operate the App: device type and operating system, app version, language, time zone, and basic error and crash events.
- Authentication tokens used to keep you signed in.
(c) Information we receive from your Service Company.
- Job assignments, customer addresses, access codes, and other operational information needed for you to perform your work.
- Updates to your account status, role, or employment with the Service Company.
We do not collect device advertising identifiers (such as Apple's IDFA or Android's Advertising ID), and the App does not include third-party advertising or cross-app analytics SDKs.
4. How We Use Information
We use the information described above to:
- (a) operate the App and provide its features (sign-in, route navigation, service-visit recording, photo upload, voice transcription, and similar);
- (b) communicate with you about your account (for example, magic-link sign-in emails);
- (c) maintain the security and integrity of the App and the underlying platform, including detection and prevention of fraud, abuse, and unauthorized access;
- (d) comply with our legal obligations and enforce our Terms of Service; and
- (e) improve and develop the App.
5. AI-Assisted Features
The App uses artificial-intelligence services to power features like technical suggestions, voice transcription, and drafted communications. When an AI feature is used, the relevant input (for example, an audio clip, a photo, or text you have entered) is sent to an AI provider, processed to produce a result, and returned to the App.
We do not use technician-generated data to train Chisel's own AI models. We engage AI providers under terms that prohibit them from using inputs we send to train their general-purpose models.
6. Aggregated and Anonymized Information
We may create aggregated or de-identified information from the data we hold — for example, aggregate metrics about app usage, average service times across regions, or model-quality measurements. This information cannot reasonably be linked back to you and is not treated as personal information under this Policy. We may use and share aggregated or de-identified information for any purpose, including improving the App, publishing benchmarks, or general business analysis. We do not attempt to re-identify it.
7. How We Share Information
We share personal information only as follows:
(a) With your Service Company. Data captured through the App is made available to your Service Company in its administrative dashboard. Your Service Company controls its further use within its organization.
(b) With service providers that operate parts of the platform on our behalf. These include providers of cloud database hosting, file storage, transactional email, mapping and geocoding, speech-to-text, and AI inference. Service providers are contractually required to handle the data only as we direct them and only as necessary to provide their services.
(c) For legal and safety reasons. We may disclose information when we believe in good faith that disclosure is required by law or legal process, to protect Chisel's rights or property, to protect the safety of you, our users, or the public, or to investigate suspected wrongdoing.
(d) In a corporate transaction. If Chisel is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to standard confidentiality protections.
We do not sell personal information, and we do not "share" personal information for cross-context behavioral advertising as those terms are defined under California law.
8. Where Data Is Stored
All personal information collected through the App is stored within the United States. The service providers we use to operate the App also process information within the United States.
9. How Long We Keep Information
We retain information for as long as your Service Company's account remains active on the platform. When a Service Company account is deleted, the personal information associated with that account — including data captured by its technicians — is deleted from our active systems within a reasonable period and removed from routine backups according to our backup-retention schedule.
If you stop using the App but your Service Company's account continues, the work history associated with you remains on the platform under your Service Company's control. They may instruct us to delete or modify your data sooner.
We may retain limited information for longer where required by law, to resolve disputes, or to enforce our agreements.
10. Security
We use industry-standard administrative, technical, and physical safeguards to protect personal information, including encryption in transit, encrypted storage at rest, scoped access controls within our team, and regular review of our security practices. No system is perfectly secure, however, and we cannot guarantee that information will always be protected against every threat. You are responsible for keeping your sign-in email account, device, and credentials secure.
11. Your California Privacy Rights
If you are a California resident, the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) give you the following rights, subject to certain exceptions:
(a) Right to know. You may request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of that information, our purposes for collecting it, and the categories of third parties with whom we share it.
(b) Right to delete. You may request that we delete personal information we have collected from you, subject to legal exceptions (for example, where we are required to retain it).
(c) Right to correct. You may request that we correct inaccurate personal information.
(d) Right to opt out of sale or sharing. We do not sell personal information, and we do not share it for cross-context behavioral advertising. There is therefore nothing to opt out of, but you have the right to confirm this in writing from us.
(e) Right to limit use of sensitive personal information. The only category of "sensitive" personal information we collect is precise geolocation, and we use it solely to operate the App's features (recording arrival and departure at assigned job sites). We do not use sensitive personal information for any purpose that triggers your right to limit its use under CPRA.
(f) Right against discrimination. We will not discriminate against you for exercising any of these rights.
To exercise any of these rights, contact us at legal@chiselindustries.com. We will verify your identity (typically by confirming control of the email address associated with your account, or by requesting additional information where necessary) and respond within the time period required by California law (generally 45 days, extendable in limited cases).
Categories of personal information we have collected in the prior 12 months:
- Identifiers (name, email);
- Audio, electronic, visual, or similar information (photos and voice recordings);
- Geolocation data (foreground GPS at assigned job sites);
- Professional or employment-related information (role, Service Company affiliation, work activity);
- Internet or network activity information (app usage and device information needed to operate the App); and
- Inferences drawn from the above (AI-generated suggestions and analyses).
The sources of this information are you, your Service Company, and the App itself. The purposes are those described in Section 4. The categories of recipients are described in Section 7.
12. Children's Privacy
The App is not directed to anyone under 18, and we do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has provided us with personal information, please contact us so we can take appropriate action.
13. Changes to This Policy
We may update this Policy from time to time. If we make material changes we will notify you through the App or by other reasonable means and will update the "Last updated" date above. Your continued use of the App after the updated Policy takes effect constitutes acceptance of the updated Policy.
